Who is responsible?

NearPin is a trade name of Martijn Moes, trading as Intermoes (sole proprietorship, Chamber of Commerce number 53229924), Hellehoek 7, 3238 AE Zwartewaal, the Netherlands. We are responsible for the processing of personal data through nearpin.io, the customer portal, the marketing pages and the public SEO location pages. For privacy questions, contact demo@nearpin.io.

What personal data do we process and why?

Demo request and contact: if you request a demo or get in touch, we process the details you provide yourself: name, email address, company name, phone number and message. We use these to contact you and handle your request.

Newsletter: if you sign up for our newsletter, we keep your email address, your IP address and what you fill in yourself (salutation, name and target group) until you confirm the signup. If you do not confirm, we delete them after 7 days. After confirmation the details are held by Laposta, which sends the newsletter, and we delete them on our side. You can unsubscribe at any time with the link at the bottom of every newsletter.

Account and subscription: for an account we process your name, email address, password (stored encrypted only), two-factor authentication data and invoicing details such as company name, address and VAT number. We use these to manage the account, run the subscription and issue invoices.

Team members: the owner of an account can invite colleagues. For that we keep their email address and the invitation, which is valid for 7 days. If the owner removes a team member and chooses to block them from being added again, we keep that email address on a block list for as long as the account exists. We only do this so we can stop a new invitation.

Payment: the payment itself and your bank details are processed by Mollie. We receive the payment status and keep the invoices.

Login and security: for every login attempt, successful or not, we store the email address, IP address and browser. We use this to prevent abuse.

Business contacts: to reach out to businesses we use company details from public sources, such as a business email address. If someone replies, we keep that reply to respond and arrange a meeting. We use an AI service (OpenRouter) to process such replies; the text of the reply is sent to that service for that purpose.

The widget: the NearPin widget on our customers' websites does not use cookies and does not collect personal data about visitors. We count impressions and clicks anonymously, without knowing who they belong to. We also track whether this happens on a phone, tablet or computer, without storing browser data or the IP address for this. We use a visitor's IP address only briefly to block excessive requests.

The marketing website: we process only the technical data needed for secure operation. Analytics is loaded only after your consent; declining has no negative consequences.

Sources and responsibility for POI data

POI data may come from OpenStreetMap (OSM), public government and register data, and obtained lists for which NearPin has usage rights. OSM data is used under the Open Data Commons Open Database License (ODbL); the required attribution is included at the relevant place or in the source credit.

Source data can be incomplete, outdated or incorrect. NearPin checks and enriches data as carefully as possible but does not guarantee that every POI is always up to date. An owner or visitor can report an error via demo@nearpin.io.

Who do we share data with?

We use services from other parties to make NearPin work. They only receive the data needed for that purpose.

Mollie processes payments and direct debits. Acumulus (SIEL BV) creates and keeps our invoices and bookkeeping. Dannik provides the hosting for our systems and our mailbox and also sends our emails. OpenRouter processes text with AI, including replies from business contacts. Laposta sends our newsletter. OpenStreetMap supplies the map images on our website and in the widget. Your browser fetches them directly from OpenStreetMap, so OpenStreetMap sees your IP address. Google Analytics measures use of the marketing website, only after consent.

If the law requires us to provide data to a government authority, we do so.

How long do we keep data?

We do not keep data longer than necessary. We keep invoices and the related data for 7 years, because the law requires it.

We keep login attempts for 90 days. We keep anonymous widget statistics in detail for 35 days; after that only totals remain.

We keep demo requests, contact requests and personal data of business contacts for up to 12 months after the last contact. After that we delete or anonymise them. Data about a company or location itself remains.

We keep account data for as long as the account exists. After an account is deleted, we delete personal data on request, unless a legal retention obligation applies.

If nobody logs in to an account for a year, we close it. We email a warning one month and one week beforehand. We do not close an account with a running subscription, an active widget or an open invoice.

How do we secure data?

Our websites are secured with https. Passwords are stored encrypted and cannot be viewed. The customer portal and the admin panel are secured with two-factor authentication.

If something does go wrong with the security of your data, we report this to the Dutch Data Protection Authority where the law requires it and contact you if needed.

What are your rights and who can you contact?

You have the right to ask which data we process about you (access), to have it corrected or deleted, and to object to the processing. Send your request to demo@nearpin.io. We respond as soon as possible and in any case within a month. We cannot delete all data: invoices are subject to a statutory retention obligation.

Not happy with how we handle your data? Please contact us. You can also file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

Changes

We may update this privacy policy, for example when we add new services or when legislation changes. The date at the top of the page shows when it was last updated.
